The former Members of the Opposition are concerned that the Prime Minister has breached the Constitution by purporting to appoint new State Ministers after the dissolution of Parliament.
The former Members of the Opposition are aware that both Samson Samsen, allegedly the new Minister of Youth Development, and Havo Moli, allegedly the new Minister of Foreign Affairs, both swore and signed their oaths of allegiance after Parliament had already been dissolved.
Article 42 of the Constitution is clear that only Members of Parliament can be appointed as Ministers. At the time they swore and signed their oaths, both Samsen and Moli were no longer Members of Parliament.
The former Members of the Opposition are calling upon the Prime Minister and the State Law Office to justify to the public why these appointments should not be considered unlawful and a breach of the national Constitution.
